Ask This One Question Before You Choose a Commercial Real Estate Broker

The answer will tell you everything about whose interests are actually being served: yours or the landlord’s.

Most tenants and buyers pick a commercial real estate broker the same way they pick any professional, by reputation, by referral, by who picks up the phone. What almost nobody thinks to ask is this: Does this broker have any of these properties listed?

It’s a simple question. The answer changes everything.

When a broker holds a listing, they work for the landlord. That is not an opinion. It’s a legal obligation. Every piece of information they share, every term they put on the table, every concession they offer or hold back flows from a duty to the owner who hired them. Walking through a property with a listing broker means sitting across the table from someone whose loyalty belongs to the other side of your deal.

When the listing is theirs, so is the landlord. You are not their client, you are the transaction.

This arrangement has a name: dual agency. It is standard practice in commercial real estate, and most tenants and buyers never know it’s happening until the deal is done and the terms aren’t quite what they expected.

What Exclusive Tenant Representation Actually Means

A broker who represents only tenants, owner-users, and buyers has no listings and no landlord relationships pulling at their judgment. Every recommendation they make, on pricing, on lease terms, on what to accept and what to push back on, serves one interest: yours.

The experience gap between a landlord’s broker and an unrepresented tenant is one of the most exploited dynamics in commercial real estate. Landlords and their brokers negotiate leases constantly. Most tenants do it once every five to ten years. That gap is deliberate and profitable, for the other side.

An exclusive tenant rep closes it. They track every available option including off-market space, create real competition among landlords, run financial modeling across multiple properties, and scrutinize lease language for provisions that cost tenants dearly: uncapped expense escalations, restrictive subletting clauses, hidden capital pass-throughs, and force majeure traps.

Without competition among landlords, there’s no urgency to negotiate. A good tenant rep creates that competition, and then uses it.

What the Market Is Doing to Tenants Right Now

The commercial real estate market in Southern Arizona, and nationally, has shifted in ways that put tenants at a disadvantage they may not see coming. Buildings sold at record prices in recent years. Construction costs are up sharply. Vacancy in key submarkets is tightening.

Landlords are responding by pushing harder: raising asking rents, cutting Tenant Improvement Allowances, shrinking or eliminating free rent periods, escalating property tax pass-throughs, and raising insurance deductibles. These are not market conditions. They are negotiating strategies, and they work best against tenants who don’t know what the real numbers are.

A skilled tenant rep sees through manufactured urgency, counters landlord tactics with real market data, and makes sure you are never pressured into terms that don’t hold up once the lease is signed.

The Cost of Getting This Wrong

Commercial real estate is typically a company’s second-largest operating expense, after payroll. A lease signed without proper representation, or with a broker whose loyalty runs to the landlord, can cost tens of thousands of dollars over its term in above-market rents, missed concessions, and unfavorable clauses.

Most tenants manage every other major expense line with care. Real estate deserves the same discipline. The difference between a represented tenant and an unrepresented one rarely shows up in the headline rent. It shows up in the total cost of occupancy over five or ten years.

Before you tour a single building, before you respond to a listing broker’s follow-up, before you sign anything, make sure you have someone whose only job is to get you the best possible deal.
